Requirements for Building Permits:

- Building Application - completed application - including signatures and notaries.
- Two sets of construction drawings that have been prepared in a standard architectural manner and to scale. All plans require original inked seal and signature of a licensed professional engineer (P.E.) or registered architect (R.A.).
- Two copies of the survey of the property.
- Contractors insurance certificate for worker's compensation liability that names the Village of Westbury as holder. Affidavit for exemption of worker's compensation insurance if the homeowner is performing the work.
- Letter from the Westbury Water District - hookup availability (new construction).
- Permit Fee(s) (see schedule below): All checks made payable to the Village of Westbury.
·The Superintendent of Buildings will determine the permit fee based upon the reasonable estimated cost of construction.
Once a Permit has been issued:
- Permitee must display the issued Permit Card and it must remain visible at all times.
- Routine Inspections - permitee must call the Buildings Department at least 48 hours prior to the desired inspection date.
·At the time of inspection, there must be a full set of approved/stamped building plans for that site.
Requirements for a Certificate of Occupancy or Completion:
- Compliance with the Code of the Village of Westbury and its zoning regulations, and the State of New York Uniform Fire and Building Codes.
- Final electrical inspection approval and submittal of Certificate of Compliance (U.L.)
- Final up-dated survey
- Final inspection made by this department

Q: If I apply for a building permit, how much will my taxes increase?
A: The Buildings Department does not make or influence the calculation of taxes. Your Village tax is derived by multiplying the assessed valuation of your property and the tax rate adopted by the Board of Trustees at its annual budget hearing.
The assessed value of all property in the Village is updated annually whether you apply for a permit, certificate of occupancy (C of O) or certificate of completion (C of C) or not. The value of the additions taking place to a property over time are assessed individually (when applicable) and added to the total assessed value for the property. Specific questions regarding this process can be discussed directly with the Village Assessor.
Q: Do you still need a permit even it is not a permanent structure?
A: Yes, almost any structural change requires a building permit, as well as a C of O or C of C when completed.
Q: If I already have an existing fence and I want to replace it, do I still need a permit?
A: If you are replacing an existing fence, for which you or a prior owner has already received a permit, with the exact same type of fence, you do not need a new permit. If you were replacing the fence with a different type and/or size, then you would be required to obtain a new permit.
Q: I just bought my home 3 months ago and have just discovered that there are no permits or C of C's for an outside cellar entrance. I realize that my property is in violation, but do not understand why is it up to me to legalize it when I purchased the home that way?
A: Even though the work may have been done previous owners or by the original owner as long as 75 years ago, you are responsible to legalize any existing violations or structural deficiencies as the current property or homeowner. This information should have been revealed to you prior to the purchase of the premise by way of your attorney or title company.
